Picture this: it was early 2021, we had just released our first podcast episode and were trying to learn how to market our newly minted Instagram account. We searched for other creators to connect with and found an account that had shared headline making, leaked audio of Jen Shah. This was pre-arrest so it was the only Jen "tea" that was out at the time. This account had 2000+ followers and counting then, but it seemed like they had an in or were incredibly good at finding sources. We added them to stay on top of the news. In this episode Cesie's trial has restarted so John and I discuss some of the events surrounding the Georgia RICO case being brought against Young Thug, AKA Jefferey Lamar Williams. I have a LOT of strong opinions about rap lyrics being used as evidence in a criminal case (spoiler alert - I'm against it) and we discuss the difficulties the court and parties have had in trying to select a jury for this high profile case, i.e. potential jurors being held in contempt for a variety of things including calling the judge "a bitch" in open court and failing to show up for jury duty. I also explain to John that our First Amendment guarantee of freedom of speech doesn't mean that you can just say whatever you want at any time during court proceedings. This is just the beginning of this case (a jury hasn't even been selected yet) and the trial is expected to last almost a year when and if it starts - so let us know your questions as it goes. (This was supposed to be a mini-episode so we didn't even get to some of the other incidents such as an attorney using the word "cap" when speaking to the Judge and alleged drug possession by another attorney, but we will cover more as the case continues.) Todd and Julie Chrisley were sentenced on November 22, 2022 after a jury found them guilty of many federal criminal charges including conspiracy to commit bank fraud, bank fraud, wire fraud, and conspiracy to commit tax evasion.The sentencing involved the government and Todd and Julie submitting memorandums outlining what sentences they believed they deserved based on the crimes committed, level of responsibility taken, prior crimes, and more. As you have probably heard, there is a new civil case waiting in the wings to be filed against Erika and others related to Tom Girardi's law firm. This lawsuit has not yet been filed, but we have seen the nearly 100-page draft complaint accusing Erika Girardi of violating the Racketeer Influenced and Corrupt Organizations Act, ("RICO"). Though Jen Shah’s trial has been moved, we still wanted to give you some insight into the case, starting with the sentencing process and the sentences some of her co-defendants have already received. As we discuss, the process includes sentencing submissions in which both sides put forth what they think the defendant should get, and the defendant puts forth evidence of their good behavior and states what led them to commit the crime. They are fascinating and help humanize the defendant. Another part of sentencing is the sentencing hearing where both sides argue about what the defendant should get based on several factors, the defendant often gives a statement, and the judge issues a sentence. Who knew a new housewife would bring us so many lawsuits to summarize? We were due for a Girardi update, weren't we? Now that the season of Beverly Hills is over, we thought we should revisit the Girardi cases and provide an overview of what has happened since we released our last Girardi update this past June. There have been HUGE filings and allegations made within the bankruptcies that we had to share.
